With the introduction of what is called a Life Interest Trust (LIT), you can protect your property against sideways disinheritance. Sideways disinheritance is when a spouse dies and leaves everything to the survivor, a few years go by and the survivor remarries, they then decide to leave the entire estate to new spouse, or split the estate etc. By utilising the LIT you can ensure your share of the estate passes to your children after the survivor has died, even if they have married etc. It is something that I personally have in my Will, it is not to restrict my wife if I were to pass, quite the opposite. It enables her to live her life without worrying about jeopardising my wishes. This trust is in written into your Will on top of the foundation that is included in the Simple Will.
